These Terms and Conditions ("Terms") govern your access to and use of the Binami website, mobile experience, and related services (together, the "Platform"). By creating an account or using Binami, you agree to these Terms.
1. Who we are
Binami is a platform that allows eligible users to buy, hold, and manage digital assets, and to fund accounts using local African payment methods such as mobile money and bank transfer where available.
2. Eligibility
- You must be at least 18 years old (or the age of majority in your country).
- You must have full legal capacity to enter into binding agreements.
- You must not use the Platform if applicable law prohibits you from doing so.
- We may request identity or other checks before enabling certain features.
3. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. Notify support immediately if you suspect unauthorised access. We may suspend or restrict accounts that appear compromised, abusive, or non-compliant.
4. Buying and holding digital assets
Orders to buy digital assets are subject to availability, market prices, payment confirmation, and our internal risk checks. Balances shown in your wallet reflect assets attributed to your account on the Platform. Digital asset prices move quickly; the value of your holdings can rise or fall.
5. Payments
You may fund purchases using supported local methods (including M-Pesa, Airtel Money, MTN MoMo, Orange Money, bank transfer, and cards where offered). Payment success depends on your provider and network. Failed, reversed, or disputed payments may delay or cancel orders.
6. Prohibited use
- Fraud, money laundering, terrorist financing, or other illegal activity
- Circumventing limits, security controls, or identity checks
- Abusing promotions, referrals, or support channels
- Attempting to disrupt or reverse-engineer the Platform
7. Fees and taxes
Applicable fees will be shown before you confirm a transaction where practicable. You are solely responsible for any taxes arising from your use of Binami in your jurisdiction.
8. Risk disclosure
Cryptocurrency is volatile and may not be suitable for everyone. You can lose some or all of the value of assets you buy. Past performance is not a guide to future results. Binami does not provide investment, legal, or tax advice.
9. Limitation of liability
To the fullest extent permitted by law, Binami is not liable for indirect, incidental, or consequential losses, including lost profits or data, arising from your use of the Platform or from market movements. Our total liability for any claim is limited to the fees you paid us in the three months before the claim, except where liability cannot be limited by law.
10. Changes and termination
We may update these Terms from time to time. Continued use after changes means you accept the updated Terms. We may suspend or close accounts for breach of these Terms or legal requirements. You may stop using Binami at any time, subject to any open transactions.
